Welcome to Viral Data Race Studio. By accessing or using our service, available at viraldatarace.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Viral Data Race Studio ("we," "us," or "our"). By using Viral Data Race Studio, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms.

Please read these Terms carefully before using the service. Your continued use of Viral Data Race Studio constitutes your acceptance of and agreement to all of the terms and conditions contained herein.

Viral Data Race Studio is a web-based tool for creating bar chart race animation videos. The service offers 14 pre-built data templates, 7 color themes, and multiple export formats optimized for social media platforms including TikTok, YouTube Shorts, and Instagram Reels.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

Free Tier: No account registration is required to use the Free tier. You may access the editor, create animations, and export videos without providing any personal information.

Pro Tier: Upgrading to the Pro tier requires a valid email address and payment through Stripe, our third-party payment processor. By subscribing to the Pro tier, you agree to the following:

• The Pro subscription is billed at $9 per month, charged on a recurring monthly basis via Stripe.
• Pro features are activated immediately upon successful payment confirmation.
• You may cancel your subscription at any time through the Stripe customer portal. Cancellation takes effect at the end of your current billing period.
• We offer a 7-day money-back guarantee for your first Pro subscription. If you are not satisfied, contact us within 7 days of your initial subscription date for a full refund.
• You are responsible for keeping your email address and payment information up to date.

You agree to use Viral Data Race Studio only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Use the service for any purpose that is illegal or prohibited by these Terms, or in furtherance of any illegal activity.
• Employ automated scraping, bots, crawlers, or other automated means to access, copy, or interact with the service in a way that degrades performance or availability for other users.
• Attempt to bypass, circumvent, or remove Pro tier restrictions, including but not limited to the watermark on Free tier exports, resolution limits, or duration limits.
• Redistribute, resell, sublicense, or otherwise make the Viral Data Race Studio tool itself available to third parties as if it were your own product or service.
• Upload, submit, or include data or content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the service.
• Interfere with or disrupt the integrity or performance of the service or its underlying infrastructure.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including without limitation, reporting such conduct to law enforcement authorities and suspending or terminating access to the service.

Your Content: You retain full ownership of all data you input into the service and all videos you export. You are solely responsible for the content of your data and the resulting video exports. By using the service, you grant us a limited, non-exclusive license to process your data solely for the purpose of rendering and exporting your requested animations.

Our Property: Viral Data Race Studio, including but not limited to the tool, application code, user interface, templates, themes, branding, logo, and all associated intellectual property, is and shall remain the exclusive property of Viral Data Race Studio. Nothing in these Terms grants you any right, title, or interest in our intellectual property except as expressly stated herein.

Watermark: Videos exported under the Free tier include a Viral Data Race watermark. This watermark is part of our branding and intellectual property. You agree not to remove, alter, obscure, or attempt to bypass the watermark on Free tier exports.

Commercial Use of Exports: You are free to use your exported videos for commercial purposes, including but not limited to publishing on YouTube, TikTok, Instagram, Twitter/X, and other social media platforms, embedding in presentations, and using in paid advertising campaigns. This applies to both Free tier (with watermark) and Pro tier exports.

All payments for the Pro tier subscription are processed securely by Stripe, a PCI-compliant payment processor. We do not store, collect, or have access to your credit card information. All payment data is handled exclusively by Stripe in accordance with their security practices and privacy policy.

Refund Policy:

• We offer a 7-day money-back guarantee from the date of your first Pro subscription purchase.
• To request a refund within the 7-day period, email us at support@viraldatarace.com with your subscription details.
• Refunds are processed back to the original payment method through Stripe and may take 5–10 business days to appear on your statement.
• After the 7-day guarantee period, no refunds will be issued for partial billing periods or unused subscription time.
• If you cancel your subscription, you will continue to have access to Pro features until the end of your current billing period.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the service will be uninterrupted, error-free, secure, or available at all times. We make no warranty regarding the quality, accuracy, timeliness, or completeness of any content or exports produced through the service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRAL DATA RACE STUDIO AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.
• Any loss of data, exported videos, or content resulting from service interruptions, technical failures, or any other cause.
• Any unauthorized access to or alteration of your data or transmissions.
• Any damages arising from third-party services, including but not limited to Stripe payment processing.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT OF SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES, OUR MAXIMUM LIABILITY SHALL NOT EXCEED TEN DOLLARS ($10).

We reserve the right to suspend or terminate your access to the service at any time, without prior notice, for conduct that we believe, in our sole discretion, violates these Terms, is harmful to other users, to us, or to third parties, or for any other reason.

You may stop using the service at any time. No special action is required to discontinue use of the Free tier. If you have an active Pro subscription, you may cancel at any time through the Stripe customer portal. Your Pro access will remain active until the end of your current billing period.

Upon termination, your right to use the service will cease immediately. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, limitations of liability, and dispute resolution provisions.

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide additional notice (such as a banner on the website or an email notification to Pro subscribers).

Your continued use of the service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the service and, if applicable, cancel your Pro subscription.

We encourage you to review these Terms periodically to stay informed of any updates.

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which Viral Data Race Studio operates, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms or the use of the service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the applicable jurisdiction.
